Terms and Conditions

8.villas is a trademark of the German Travel Graph GmbH which provides a reservation service for individual accommodation being let for self-catering holiday. Other than for hotels each Property is unique and only available in total and does not have standards or categories. Therefore bookings are often final and changes are very difficult to handle.

8.villas acts only as an agent and payment gateway on behalf of all of the Properties and all bookings are made on behalf of the person booking and staying at the property including and all those named on the booking (the ‘Guest’). Therefore 8.villas accepts no liability in relation to any contract the Guest enters into or for the property the Guest books through this website (the ‘Property’) or for the acts or omissions of any supplier or other person or party connected with any Property. For all bookings, the Guest’s contract will be with the owner/supplier/principal of the Property in question (the ‘Owner’). When making the booking 8.villas will arrange for the Guest to enter into a contract with the applicable Owner of the Property. The Guest’s booking with 8.villas is subject to these terms and conditions and the specific booking conditions of the relevant Owner the Guest contracts with (if any). The Guest is advised to read both carefully prior to booking. The Owner’s terms and conditions may limit and/or exclude the supplier’s liability to the Guest. Property specific terms and conditions for each Owner are listed with the Property prior to booking. By booking a Property the Guest agrees to those terms and conditions.

When the Guest requests a booking, the availability is double checked by the provider of the Property and/or the Owner (verification period). If the availability is confirmed, 8.villas makes the booking final and charges the deposit. The user receives a definite booking confirmation – normally within 24 – 48 hours. Otherwise 8.villas sends an offer for a similar booking, which the Guest has to confirm or the reservation will be canceled.

Any special requirements should be requested within the booking request. 8.villas and the Owner will do their best to meet your demands.

Payment

Because of the individual character the deposit payment is necessary for the reservation request which is held as reservation on the credit card for the verification period. If the availability is confirmed, the payment will be charged; otherwise the amount will be released. By confirmation the contract between the Guest and the Owner is closed.

Usually, the deposit is 20 % of the total amount. The remaining balance has to be payed at least 14 days before the arrival date. The Guest will be informed by 8.villas in advance how to make the final payment. If the Guest fails to pay the outstanding payment, the reservation could be cancelled and a penalty could arise.

In case of a short-term booking less than 14 days in advance the total amount has to be payed for the booking request.

The rate for the villa includes all costs if not stated otherwise in the description. Taxes and service fees apply as quoted on the checkout page.

When the full payment is received, a booking voucher including all information, directions and transfer arrangements is been sent to the Guest, which has to be presented along with the Guest’s passport or id upon arrival. Otherwise the access to the Property could be rejected without compensations.

Typically, telephone and internet charges and provisioning costs will be the Guest’s responsibility. Gratuities for household staff are encouraged and normal, but are left entirely to the Guest’s discretion.

Once the Guest’s booking is confirmed, the price of the Guest’s reservation is fully guaranteed, even if 8.villas changes the price on its website after the Guest’s booking has been confirmed. In return for this commitment, no refunds will be made for any exchange rate fluctuations that would otherwise reduce the rental cost.

8.villas reserves the right to impose any taxes or other charges which may be implemented by any government or other regulatory body, which were unknown at the time of publishing. 8.villas will tell the Guest promptly in the unlikely event that it becomes aware that any taxes or charges will apply to the Guest’s booking.

Use of Property

Please treat the Property accordingly, as it is typically someone’s home. Properties are generally located in quiet residential neighbourhoods. Therefore the Guest and his visitors are asked to behave appropriately and abandon illegal or immoral activities including gambling, prostitution, drugs, possession or use of pyrotechnics or dangerous goods, and possession or use of firearms and other weapons. Smoking is generally prohibited unless stated otherwise. The Guests are reliable for all loss or damage or special cleaning requirements.

In case of behavior not in a suitable manner, excessive or unacceptable loss or damage or other improper use of the Property the Owner or his representative could require the Guests including visitors to vacate the Property immediately without compensation.

The Property and its facilities are available for normal holiday purpose for the Guests only. If additional persons other than normal visitors should get access to the Property for an event like a wedding or a party, this has to be authorised in advance. If the Guest plans to hold an event, request this at the time of booking, as special approval or arrangements may be required and are not always available.

Typical check-out and check-in times are 12:00am and 3:00pm. In case of early arrival or late departure 8.villas will do their best to arrange individual aggreements.

From time to time the Owner or his staff may need access to the Property for maintenance or service. The Guests are required to give them reasonable access to the Property in accordance to their schedule.

As it is a booking condition the number of persons (adults and children) staying at the Property must not exceed the maximum number of sleeping places indicated, without prior written consent. Otherwise any insurance policy on the Property may be invalidated or access to the Property may be refused or limited. Pets are solely allowed if stated in the description of the Property or authorised in advance.

Safety should be respected at the Property at all times. Suitable supervision should be given especially with children around pools, beaches and roads, and when using the Property’s facilities.

Self-catering accommodations require that the Guest supply all provisions and consumables necessary for daily living. The staff at the Property may accommodate any reasonable requests to purchase provisions on the Guest’s behalf, and this will be charged to the Guest’s account.

Security deposit

A security deposit may be payable directly to the Owner upon arrival. The standard security deposit required for each Property is stated in the description; however the Owner or his representative has the right to impose different requirements on a case by case basis. Access to the Property may be refused if security deposit is not paid in full. When the security deposit is required to be paid in cash, or when a non-standard security deposit applies, 8.villas will inform the Guest in advance of the amount payable and any other conditions.

The security deposit will normally be refunded at the end of the rental period, after deducting all costs the Guest is reliable for. The Owner has the right to deduct supplementary charges from the security deposit if the Property is not vacated at the stated time or in the event of any other breach of the agreement by the Guest. It is further recommended that the Client take out personal liability and accidental damage insurance for all members of the party to cover against accidental or negligent damage to the property, and protect against loss in the event of a deduction from the security deposit.

Changes and Cancellations

Because of the individual character of the accommodation offered bookings are often final and changes are very difficult to handle. Although 8.villas will do the best to accommodate any reasonable change, the Guest should be aware that some changes my not be possible and refunds could be limited. Therefore it is strongly recommended that the Guest takes out a trip cancellation insurance.

If the Guest wishes to cancel a confirmed booking, written notice of cancellation must be sent to 8.villas. These requests will be acknowledged by 8.villas.

In the event that the Guest cancels a confirmed booking, the following cancellation fees will generally apply:

  • 20% of the total rental amount will be forfeited if the cancellation is made more than 14 days before the start of the rental period
  • 50% of the total rental amount will be forfeited if the cancellation is made between 8 and 14 days before the start of the rental period.
  • 100% of the total rental amount will be forfeited if the cancellation is made between 1 and 7 days before the start of the rental period.

The applicable amount will be deducted from deposit and payments, and the remaining balance will be refunded to the Guest. For each amendment a fee of EUR 50 will apply.

In the very unlikely event that the Owner is unable – for any reason (including the sale of a Property and force majeure) – to provide the Guest with the Property booked by the Guest, 8.villas reserves the right to transfer the Guest and their party to an alternative Property of similar type and value, in consultation with the Guest. If the price of the substituted Property is less than the original booking, the difference will be reimbursed to the Guest. If the price of the substituted Property is higher than the original booking, the difference may be charged to the Guest. If, however, after considerable effort by 8.villas, no alternative of similar type and value is available and / or no agreement can be reached between the Guest and 8.villas, then either 8.villas or the Guest may opt to cancel the booking and the rental contract. In that event, 8.villas will refund the Guest all payments, without further compensation. 8.villas strongly recommends that the Guest takes out a holiday insurance to ensure against any losses incurred by an Owner cancellation.

Disclaimers

8.villas has taken every care in compiling the information (descriptions, photos, assessments, ratings and surrounding locations) about the Properties. These are provided by the Owners / advertisers and reproduced in good faith. None of the information is provided by 8.villas. The assesments and ratings are no recommondations from 8.villas and for information purposes only. 8.villas will not be held responsible for any reliance placed on these ratings and for any errors, omissions, misunderstandings or claims arising from the advertisement or any arrangement or booking made with an Owner / advertiser nor for any modifications to the Properties. Please contact 8.villas if you believe any information regarding a Property to be inaccurate, and 8.villas will investigate and correct if necessary. If some requirement is essential for you, let 8.villas verify this before booking the Property.

The Guest is aware that errors also in the pricing are possible. In this case the Guest will be informed about the correct price with to booking offer sent in reply to the reservation request. As availability is limited and subject to change only the booking offer could state a reliable availability and price. In case of change to the reservation request, the Guest has to confirm this change.

Any Guest valuables or property left or used at the Property are at the Guest’s own risk. Neither 8.villas nor the Owner or his representative accept any responsibility for loss of or damage to Guest’s property.

The Guest is responsible for the Property during the rental period, and must ensure that all windows and doors are locked securely when not on the premises. Any act or omission by the Guest, their party and/or visitors which may negate or prejudice the Property insurance policy and/or results in loss or damage is the Guest’s responsibility.

Neither 8.villas nor the Owner or his representative accept any responsibility or liability for:

  • any physical injury, sickness, death, loss, damage, inconvenience or additional expenses incurred by the Guest, their party or visitors regardless of the cause;
  • any vehicle or the contents of any vehicle used, hired or engaged by the Guest or their party during the rental period; inability of the Guest or any member of the Guest’s party to enter the location of the Property or stay at the Property for all or part of the Rental Period as a result of failure to obtain appropriate travel or visa documentation, cancellation or amendments to travel arrangements or the missing of flights or travel connections; and/or
  • any delay or cancellation of the booking as a result of war, threat of war, riot or civil strife, strike, demonstration, terrorist activity (threatened or actual), natural disaster, fire, sickness, weather conditions, action at an airport or port by any government or public authority, technical problems relating to transport and airport regulations caused by technical, mechanical or electrical breakdowns, or any technical, structural, electrical, plumbing or other problems or difficulties with the Property which make it unsafe or unusable, or any other circumstances which amount to ‘force majeure’ or Acts of God, or other events beyond the Owner’s control.

However, in the event that 8.villas is found liable to the Guest on any basis whatsoever, the maximum liability to the Guest is limited to twice the cost of the booking (or the appropriate proportion of this if not everyone on the booking is affected). 8.villas does not exclude or limit any liability for death or personal injury that arises as a result of It’s negligence or that of any of it’s employees whilst acting in the course of their employment.

Complaints Procedure

Every attempt will be made for the Guest to have an enjoyable stay. If the Guest should have a problem during the rental period, please inform the Owner or his representative immediately who will endeavour to put things right. Should the Owner or his representative not address the Guest’s problem satisfactorily, please contact 8.villas promptly. In order for the Guest’s complaint to be addressed, the Guest must communicate any problem whilst on location. If no complaint is reported during the rental period, 8.villas and the Owner will assume that the Property was to the Guest’s satisfaction and no complaint will be entertained.

8.villas and the Owner shall not be held responsible for any temporary defect or stoppage in the supply of public services to the Property such as water, electricity, gas, telephone or internet, or in respect of any equipment, machinery, or appliances in the Property or garden, which are caused by circumstances beyond the control of the Owner. But nevertheless please inform the Owner or his representative even in such a circumstance, he will do the best to remove the limitation as soon as possible or provide an alternative solution, so the Guest’s holiday won’t be compromised too much.

Jurisdiction

This agreement will be governed by the laws of the Federal Republic of Germany. In the event of controversy arising from the booking and Property rental that cannot be resolved amicably between the parties, both parties agree to exclusively refer the matter to the International Court of Arbitration of the ICC in Paris to be resolved finally by arbitration in English language.

By making its booking request, the Guest agrees that these terms and conditions have been read, understood and have been accepted and agreed to by the Guest without reservation and without exception.

If any provision of these terms and conditions is or becomes invalid, unenforceable or non-binding, or if there is any omission from any terms and conditions, the remaining terms and conditions will remain valid and enforceable and cannot be contested. The invalid contractual provision shall be replaced or the loophole filled by an appropriate provision which comes as close as possible to what the parties to the agreement would have wanted, had they considered the point.
